Burleigh Heads Cannabis Pty Ltd (ABN 73 615 904 286) (BHC) is a subsidiary of Vitura Health Limited (ABN 59 629 071 594) (Vitura).

This document outlines BHC’s Supplier Performance Program (SPP) for eligible suppliers who hold a current distribution agreement with BHC (Suppliers). There are three tiers in the SPP, these are titled: Launch, Grow, and Scale.

The program is offered to all Suppliers to BHC should they meet criteria determined by BHC from time to time. Suppliers may request to participate in the SPP at any stage during their agreement with BHC. BHC will determine what tier of the SPP a supplier will be eligible for.

The benefits of each tier are outlined in the Supplier Performance Program Matrix (Matrix https://canview.com.au/tier-overview/). Each tier in the Matrix determines if the supplier is: not entitled to the benefit (“X”); can pay a fee to receive the benefit (“$”); or they are entitled to the benefit (“✓”). A digit in the Matrix represents the amount of the benefit the Supplier will be eligible to receive in that calendar year.

All benefits are dependent on availability and BHC may, from time to time, vary the benefits to a supplier at its discretion. Should this occur, BHC will provide an equivalent (or as close to) benefit in consultation with the affected supplier. All included marketing service benefits are renewed annually and must be utilised within the 12 months they are issued. Benefits that are unutilised within 12 months from issue will expire and do not carry over to the following year. Benefits cannot be substituted or used for a rebate or refund with BHC. If a Supplier has previously been a supplier with BHC within the previous 24 months or has previously received the benefits from BHC, BHC reserve the right to limit the benefits the Supplier is entitled to.

BHC is not liable for any decisions made by the Supplier resulting from an assessment, advice or consultation BHC provides the Supplier as a benefit. Where a benefit requires additional costs, BHC will provide the Supplier with a quote for the benefit prior to providing any additional benefits.

Any content for promotions or products provided by the Supplier must meet TGA/AHPRA compliance standards, as well as any other relevant advertising standards (Standards). BHC may reject content that it considers does not meet the Standards. Without incurring any responsibility to do so, or liability, BHC may provide feedback or edit content of the Supplier to ensure compliance with the Standards.

BHC may, at its discretion, allow the Supplier access to the Vitura partnership network.
